Dans cet ouvrage pionnier, Christophe Golay décrit l'évolution de la protection du droit à l'alimentation depuis l'adoption de la Déclaration universelle des droits de l'homme de 1948. Il démontre ensuite comment il est devenu possible de garantir l'accès à la justice pour les victimes de violations de ce droit fondamental. Pendant des décennies, la majorité des Etats, de la doctrine et des juges ont considéré que le droit à l'alimentation n'était pas justiciable, en se basant principalement sur deux arguments. Premièrement, le droit à l'alimentation et les obligations des Etats n'étaient pas précisément définis. Deuxièmement, le droit à l'alimentation ne pouvait être réalisé que progressivement et en utilisant des budgets considérables, ce qui impliquait que toute intervention des juges violait la sphère de compétence des pouvoirs politiques.
